The Supreme Court has released the decision of the case related to the right of inheritance of women.
A bench consisting of Justice Athar Minullah and Justice Irfan Saadat issued a written decision in which a fine of Rs 5 lakh was imposed on petitioner Abid Hussain for delaying inheritance rights to the heirs.
The Supreme Court upheld the decision of the Sindh High Court to dismiss the appeal of Abid Hussain. In the written decision, it was said that the amount of the fine should be deposited with the Registrar Supreme Court within 7 days, the amount of the fine would be distributed among the heirs.
The decision said that ‘Abid Hussain’s claim that the property was a gift could not be proved, the right of inheritance is a divine order, depriving women of the right to inherit is against the constitution and the clear teachings of Islam, the ownership of the property is transferred to the heirs immediately after the death of the owner.
It is the responsibility of the state to give women the right to inheritance without delay, fear or lengthy court proceedings, and those who deprive them of inheritance should be held accountable under the law.
