Islamabad High Court Judge Justice Babar Sattar’s interim order has come to light when the Acting Chief Justice’s Division Bench was suspended.

According to the report, the case could not be fixed in the bench despite the direction of Justice Babar Sattar’s deputy registrar Judicial Administrative side.

Justice Babar Sattar heard the hearing despite being suspended, an 8 -page written order was issued.

Justice Babar Sattar said that the order to set the case for March 26 was not a challenge in the Division Bench, how could it be suspended, the orders of March 12 and 26 were interim and the final decision of the case has yet to come.

The court said that the Supreme Court has explained in several decisions that the Chief Justice has no authority to intervene on the administrative side in the case under the investigation.

Justice Babar Sattar summoned Deputy Registrar Judicial and Deputy Registrar IT at the next hearing.

Justice Babar Sattar said that the Deputy Registrar IT should tell which he removed the Judicial Orders from the website.

The written order stated that on seeking the deputy registrar Judicial, he submitted the note that the order division bench suspended, the deputy registrar Judicial violated the court order in Badi Nazar by not joining the case.

It said that the Deputy Registrar Judicial did not include the case in the supplementary causalist despite the instructions on the administrative side, the Deputy Registrar Judicial justified that the case cannot be fixed as per the direction of the Division Bench,

Justice Babar Sattar said in his order that apparently the division bench was not properly supported that it was an interim order.

Justice Babar Sattar cited Section 3 of the Law Reforms Ordinance 1972 in his order, the court said that under the law Reform Ordinance, an intercourt appeal could be filed against the final decision of the single bench, seeking records or a constitutional court.

Justice Babar Sattar said that the case is fixed for the next hearing on May 7, the registrar’s office should be included in the case causalist, even if the case is not included in the causalist, the hearing will be held on May 7.

Justice Babar Sattar added in his order that a copy of the order should be sent to all parties so that they can ensure their attendance at the next hearing, making the order part of the record so that the division bench can also come to know.

He said that the Deputy Registrar Judicial should appear in the court at the next hearing. The Deputy Registrar should explain why not take action against them for violating the court order.

Justice Babar Sattar said that if the division bench does not order to send the record to this court, then the registrar made a new record in the office file,

Justice Babar Sattar had issued a contempt of court notice to the DG Immigration and Passport and Director NAB. The division bench, headed by Acting Chief Justice Sarfraz Dogar, suspended the order of Justice Babar Sattar.
