The High Court had given time to the Pataudi family to present their case in the appellate authority but the Pataudi family did not present their case in the given time. Now the family has the option to challenge the order in the division bench.
What is the whole matter?
Let us tell you that the stay on the historical properties of Bhopal state since 2015 has now been abolished. Madhya Pradesh High Court (Jabalpur) has directed actor Saif Ali Khan, mother Sharmila Tagore, sisters Soha and Saba Ali Khan and Saif’s aunt Sabiha Sultan to present their case before the appellate authority in the enemy property case. . But the Pataudi family did not present their side within the stipulated time. This duration has now ended and no claim has been made by the family.
Why can Saif’s property come into the possession of the government?
The Enemy Property Act was enacted in 1968. Under this, the Central Government has the right over the properties left in India by the people who went to Pakistan after partition. After the stay is lifted, the government can now bring the Nawab’s property under the ambit of the Enemy Property Act and take it into its custody under the 2015 order. The central government had stated in 2015 that the legal heir of Nawab Hamidullah Khan’s property was his elder daughter Abida, who had gone to Pakistan. Therefore this property comes under the enemy property law.
Sajida Sultan was Saif Ali Khan’s grandmother
At the same time, the descendants of Nawab’s second daughter Sajida Sultan (like Saif Ali Khan and Sharmila Tagore) are staking their claim on this property. Sajida Sultan was the mother of Nawab Pataudi and grandmother of Saif Ali Khan. She lived in India all her life. His sister was Rabia Sultan who lived in India.
