Both houses of parliament have finally approved the ban on the marriage of minor girls. Under this law, a boy under 18 can no longer be married. The motive for this bill is Sharmila Farooqi, the leader of the People’s Party. If the president now approves the bill, then the law will be implemented within the capital Islamabad.
The law was enforced in Sindh province in 2013, but such law is not enforced in Punjab, Khyber Pakhtunkhwa and Balochistan. Under this law, the marriage registrar will be obliged not to register the marriage of underage children. Under another clause of the law, a marriage marriage will ensure the presence of an identity card on the computer of both parties before marriage or register.
The bill states that the marriage of a girl will be sentenced to at least 2 years and a maximum of 3 years in prison. Another clause of this law will be considered a “rap” of the young children’s consent or consent without consent or consent. 5 to 7 years imprisonment for a minor bride or groom can be fined Rs 10 lakh or both sentences.
Sharmila Farooqi described the background of the bill, saying that when the Sindh Assembly passed the law in 2013, the Islamic Ideological Council voted against the law. When the law was challenged in the Federal Shariat Court, the court rejected the opinion of the Islamic Ideological Council and wrote in its decision that the state had the power to legislate for the rights of women and children.
Prime Minister’s coordinator Rana Ehsan Afzal welcomed the passage of the bill. They say that the minimum age of marriage is also a condition of the GSP Plus status. Therefore, they are in touch with all the provinces so that the marriage age is the same all over the country.
In the subcontinent India, the most stereotypical committee has been practicing to keep men and women backward. These include enslaving men and women, harassing the wife on the death of her husband in Hindu society, and the weddings of minor girls. When the East India Company expanded its power in India and the company’s government implemented many policies to protect power and force India economically, but when the company’s power was strengthened, modern educational, judicial and administrative reforms were made. When the company’s power was expanding in India, the British was banned from enslaving humans.
The company’s government also declared slaves of human beings in India as a crime. Those who had slaves were forced to free the slaves freely. Similarly, the ritual of Sati was banned. The ritual of Sati was a cruel ritual, but in Hindu society, the burning of a living wife with her husband’s lover was presented with the status quo of bravery and honor, thus conservative Hindus opposed the law. The English government banned the marriage of minor children. Apart from the Hindu religious leaders, leaders of other religions united against this law, but young Barrister Muhammad Ali Jinnah was the only Indian leader who strongly supported the ban on the marriage of minor girls.
Barrister Muhammad Ali Jinnah’s 1929 memorable speech is part of history. He said that young children have immense disadvantages of marriages at an early age. For the first time during the reign of former President Ayub Khan, a family law was enforced to document the marriage and divorce. Under this law, it was mandatory to register for marriage and divorce and the marriage age of the girl was fixed. It was also written in the law that if the husband wanted to get married, it was necessary for him to write a written consent and without the consent of his wife, the second marriage was declared a criminal offense.
Family physician and social affairs experts researched the various contradictions found in the society in their respective fields and the losses on its country’s economy. These experts say that children under the age of 18 have many disadvantages to marriage. According to research by these experts, the tradition of getting food after men in our society as a whole is very stable. In general, girls and women get less food than men, thus girls suffer from various diseases due to less nutrition. Thus, women weakened their body due to lack of food in heritage. In this way, a baby with a mother becomes less nutritious.
That is why in Pakistan, the highest rate of maternal and child after Afghanistan is the highest. According to the World Health Organization report, 675 children born from the age of 27 to 27 months die daily. Similarly, 9800 women and 246,300 newborn babies do not survive every year. In Pakistan every year 190,000 children die in the stomach of the mother.
The death of such a large number of children and women is a tragedy for a modern state. In India, Bangladesh, Sri Lanka and Iran, etc., the maternity and child dying rate was higher at one time, but in these countries, governments banned children’s marriages and reduced the death rate of children and women by improving health facilities.
One of the major issues is to target the literacy rate in the country. Without receiving the literacy rate percentage, the number of people living below the poverty level cannot be reduced and the wheel of development cannot go ahead. Statistics show that the majority of the children who do not reach the fifth grade are girls and these girls are forced to quit due to marriage and girls are married soon in rural areas, so girls are no longer the first priority. This is the reason why experts from the UNICEF and UNESCO, a UN agency for the Welfare of the Welfare, besides the World Health Organization, say that children should not be married for 18 years. This time it was good that besides the majority of the PML -N in the National Assembly and the Senate, the PTI, the Muttahida Qaumi Movement, the National Party, etc. fully supported the law.
Emal Wali Khan, the grandson of Khan Abdul Ghaffar Khan alias Bacha Khan, the first raising knowledge of girls’ education in Khyber Pakhtunkhwa, has taken a reactionary stance to the secular identity of his party. Now, PML -N Chief Minister Maryam Nawaz has a duty to enforce this law in Punjab. The same is the responsibility of Pakhtunkhwa Chief Minister Ali Amin Gandapur and Balochistan Chief Minister. The implementation of this law will create a positive liberal face in the global scenario.
