The injunction to stop the execution of the death sentence of 5 ex-Navy officers has ended

The Islamabad High Court lifted the injunction to stay the execution of the death sentence issued by the Field General Court Martial to former Navy officers.

The Islamabad High Court disposed of the request for obtaining the documents of 5 ex-Navy officers who were sentenced to death in the dockyard attack case. Justice Babar Sattar pronounced the decision to dispose of the application after the statement of the petitioners’ lawyers. The petition was filed by former Navy officers Arsalan Nazir Sati, Mohammad Hamad, Mohammad Tahir Rashid, Hamad Ahmed and Irfanullah.

The petitioner’s lawyer Colonel Retired Inamul Rahim said that access to the inquiry report and judgment was given in the presence of the public prosecutor on the court order. However, a copy of the inquiry report and judgment was not provided. The inquiry report and judgment were shown, of which notices have been taken.

Navy officials had refused to provide a copy of the Board of Inquiry’s report to the culprits citing it as a matter of national security. The court had ordered death row convicts to have access to limited records related to them. Five Navy personnel were sentenced to death by a court-martial, which was stayed by the High Court.
