Justice Jamal Mandukhel’s decision issued by the Supreme Court consists of 12 pages, in which he has maintained his original decision on specific 39 seats.
According to the decision of Justice Jamal Mandukhel, the majority decision is not correct in the case of 41 seats. He converted the majority decision into a review in 41 seats. According to the decision, the court did not have the authority to declare 41 candidates independent.
Justice Jamal Mandukhel said in his decision that the decision regarding 41 seats is not compatible with the constitution and facts. The court cannot change the political affiliation of a candidate. The case of 41 candidates was not pending before the court.
According to the judgment, the majority decision regarding 41 candidates was “excessive”.
